Welcome to Basilico ("the App"), an AI cooking assistant. These Terms of Service ("Terms") govern your access to and use of the App. By using the App, you agree to these Terms.
1. Eligibility and Account
- You must be legally able to agree to these Terms in your jurisdiction.
- If account creation is available, you are responsible for maintaining the confidentiality of your credentials and all activity under your account.
2. Use of the App
- You agree to comply with applicable laws and these Terms.
- You will not interfere with normal operation, attempt unauthorized access, or engage in activity that harms the App or its users.
3. User Content
- You may submit content (e.g., text, images, audio) within the App ("User Content"). You retain ownership of your User Content.
- You grant us a worldwide, non‑exclusive, royalty‑free license to host, process, and display your User Content solely to operate and improve the App.
- You represent and warrant that you have all rights necessary and that your User Content does not infringe third‑party rights or laws.
4. AI‑Generated Output
The App may produce AI‑generated content. Such output is provided "as is" and may be inaccurate or incomplete. Use discretion, particularly for safety, allergens, and dietary restrictions.
5. Acceptable Use
- Do not upload illegal, harmful, or infringing content.
- Do not attempt to reverse engineer or extract source code except as permitted by law.
- Do not circumvent security or authentication measures.
- Do not use the App to create or distribute malware, spam, or deceptive content.
6. Third‑Party Services
The App uses third‑party services (e.g., hosting, databases, authentication). Your use of those services may be subject to their terms and policies.
7. Privacy
Our handling of personal information is described in the Privacy Policy. By using the App, you consent to those practices.
8. Intellectual Property
The App and its components (excluding User Content) are protected by intellectual property laws. We reserve all rights not expressly granted.
9. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non‑infringement, or reliability. We do not guarantee uninterrupted, secure, or error‑free operation.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of or inability to use the App. Our total liability for any claim shall not exceed the greater of (a) amounts you paid (if any) for the App in the 12 months preceding the claim or (b) €50.
11. Indemnification
You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the App.
12. Changes to the App and Terms
We may modify or discontinue the App at any time. We may update these Terms; material changes will be communicated within the App or by other reasonable means. Continued use after changes take effect constitutes acceptance.
13. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the App or its users.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes will be resolved by the competent courts in Amsterdam, Netherlands, unless mandatory law specifies otherwise.
